New York, NY, August 26, 2009 — Louis Posner, a New York City attorney, has retained new high profile attorneys, Robert Fogelnest, Esq. and Joseph Bondy, Esq. Posner pled not guilty to charges stemming from a sting operation at the Hot Lap Dance Club in Manhattan in July 2008.

The Manhattan State Supreme Court Judge overruled objections by the prosecutor and approved the new attorneys and payment of their reasonable attorneys’ fee from funds seized by ex parte search warrants by New York City law enforcement. Fogelnest argued that under the Fifth Amendment and Sixth Amendment to the U.S. Constitution, a criminal defendant has the right to counsel of his choice and that in a case where the government has seized all of a defendant’s funds, the payment of the attorneys’ reasonable legal fees should come from the seized funds. Relying on a 1991 decision by Judge Leslie Crocker Snyder, the prosecutor has a duty under the New York State Constitution to ensure that a portion of forfeited assets are made available for payment of reasonable attorney’s fees for defendant’s counsel of choice.

Robert Fogelnest is an internationally prominent criminal defense attorney whose primary offices are in Manhattan. He is a former President of the National Association of Criminal Defense Lawyers (NACDL), a Fellow of the American Board of Criminal Lawyers (ABCL), and a Charter Member of the New York State Association of Criminal Defense Lawyers (NYSACDL).

Joseph A. Bondy is a criminal defense attorney in private practice in Manhattan, with a concentration in federal and state trials and appeals. Mr. Bondy is a former Director of the New York State Association of Criminal Defense Lawyers, and is on the faculty of Cardozo Law School’s Intensive Trial Advocacy Program and served on the faculty of the National Criminal Defense College.
