Attorney Jeff Miller Discusses Special Issues in Florida Military Divorce Cases

A

With the divorce rate for military members eclipsing the divorce rate for civilian couples, Florida military divorce is something the legal team at DivorceYes.com sees quite a bit of. Divorce lawyer Jeff Miller explains that while military divorce cases share some similarities with typical divorces, there are also some differences that make these cases quite unique.

“One of the things that makes military divorce unique is that servicemen and women often face complex residency issues because they’re often stationed elsewhere,” says Miller. “For example, a married man who has lived in Florida his whole life might currently be stationed in Hawaii, so where would he file for divorce? Or what happens when a sailor from Kansas has been stationed for the last year in Jacksonville or Key West but recently deployed to Iraq?”

Miller goes on to explain that Florida law makes special provisions for these unique situations.

“In the case of an active military member, he/she can meet Florida’s 6 month residence requirement for purposes of the court’s divorce jurisdiction if he/she: (1) has actually resided in Florida for the last 6 months, regardless of where his/her home state is, even if deployed, or (2) establishes Florida as his/her home state with the intent to return to Florida after discharge, even if stationed outside of Florida or deployed,” Millers comments.

Miller also reminds people that special rules apply to dividing military pensions and that there are laws set up to protect active military members against being held in “default” from failing to respond to divorce action.
