Lawsuits Concerning DePuy Pinnacle Hip Implants Moving Forward

On March, 25, 2011, plaintiff Catherine Falvey filed a petition with the U.S. Judicial Panel on Multidistrict Litigation to consolidate all of the federal Pinnacle hip lawsuits that Johnson & Johnson and their DePuy Orthopeadics subsidiary is currently defending nationwide. The motion requested that the panel either designate a new court to oversee the Pinnacle lawsuits and form a separate multidistrict litigation (“MDL”) or make the Pinnacle lawsuits part of the DePuy ASR hip implant MDL, which is currently underway in the U.S. District Court for the Northern District of Ohio. If the panel agrees to form a DePuy Pinnacle MDL, the cases will either be included with the ASR hip lawsuits that are part of the DePuy ASR hip implant MDL in the U.S. District Court for the Northern District of Ohio or a new MDL will be formed that will solely focus on DePuy Pinnacle lawsuits.
